Default Problem with kernel

Hello,
we tried to install ubuntu 8.10, but I have the same problem which is descripted here.
http://bugzilla.kernel.org/show_bug.cgi?id=11541
In the end, there is written, that the problem would be fixed in 2.6.29.1 kernel. But new version of ubuntu 9.04 use 2.6.28.x version. Would it be possible to merge this fix into your kernel?

Martin, the first step would be to get a bug reported in launchpad[1] and
linked to the upstream report. I have had a quick search about and was
unable to find it reported already.
