Microsoft put a lot of money into that legal fight. SCO lost, so
apparently they decided to take another kick at the can, but more
directly this time.
They're using classic FUD to scare people into paying royalties on
software when there is no legal precedent backing MS' claims. They
simply have to tell the client/victim "Hey, we're going to try this in
court. We haven't selected a target yet..." and the company will get the
message.
Legal fights with companies sitting on the kind of cash MS has is a
nearly impossible battle to win, unless you can match them. So this has
nothing to do with facts and more to do with bullying.

It is frequently the case that even a successful defense against a patent lawsuit costs more than licensing a bogus patent.
Furthermore, there is a non-zero probability of losing said lawsuit, with costs that would significantly exceed the costs of a license.
So if w is the cost of a license
p is the probability of losing a lawsuit
z is the probability of a lawsuit even being filed
x is the cost of defending the lawsuit and winning
and y is the cost of defending the lawsuit and losing
if
w < z(py + (1-p)x)
w < z(p(y-x) + x)
Then it makes sense to just settle. Some firms may make a more conservative estimation of p than others. Some firms believe that y and x are quite close, and much larger than w - which means the probability of winning or losing doesn't really matter. Some firms assume z is 1 - a lawsuit is inevitable.

Somehow I think that a battle like this would have to be "won" by
the Average Joe's (and Jane's) out there who've had enough of
Redmond's asinine tactics. Sometimes it takes the army of ANTS to
completely paralyze and destroy the elephant. I know it's always one
of those "Yeah....but what can I do?....I'm just ONE
person" But if you REALLY consider it...we're a lot stronger in
numbers...and when I see some of the e-mail addresses here....from
places like Sweden...or Russia...and almost every corner of the
world...why CAN'T we stop 'em?.....what're they gonna do come and
slap a license on EVERY machine on the planet running Fedora?...or
for that matter running ANY version of Linux?...highly unlikely. And
it's not like we have to walk around with batons or guns....just a
simple "shedding of light" on Microsoft's tactics could get this so
far in front of the spotlight that they'd be shamed into
retreating....it may sound silly but it's better than cowering in a
corder and cursing the day they were born!....just my opinion!...
